Support to the Constitutional Review and Implementation Process

Following the coming into force of the Provisional Constitution of Somalia on 2 August 2012, the Max Planck Foundation has been working closely with the Somali institutions tasked with the implementation and the review of the Somali Provisional Constitution. These institutions include the Somali Provisional Constitution Review and Implementation Oversight Committee of the House of the People of the Somali Federal Parliament (Oversight Committee) and other parliamentary committees.

The Oversight Committee is mandated with preparing and leading the constitutional review and implementation process as provided for in the Provisional Constitution of Somalia. The Max Planck Foundation has been supporting the Oversight Committee since June 2013 by facilitating the analysis and discussion of the Somali Provisional Constitution and developing ideas and suggestions for the review of the Constitution.

Based on this long-standing and fruitful cooperation between the Somali Federal Parliament and the Max Planck Foundation, in July 2014 the European Union granted the Foundation the funds for a new two-year support project on the implementation and the review of the Somali Provisional Constitution. Apart from the continued technical legal support to the relevant Somali stakeholders of the constitutional review and implementation process, the project also expanded to include regular capacity building workshops for governmental officials from all branches of government on topics of Somali constitutional law.
