Publications

The Afghanistan Team’s publications hub showcases a curated collection of scholarly research, in-depth manuals, and legal treatises that the Afghanistan Team has produced within the context of the Max Planck Foundation’s 30+ technical legal assistance projects on and in Afghanistan.

The Max Planck Foundation, and its predecessor working group, have published dozens of legal manuals, compendia, and other forms of expert analysis since the start of its work in Afghanistan in 2005. Published in English, Dari, or Pashto, these materials range from a sophisticated commentary and practice guide to the domestic Administrative Procedure law to a bespoke companion for a constitutional dialogue combining sources and perspectives from Afghan Constitutional law, Islamic law, and comparative constitutional experiences from other countries. Of historical note are the handbooks on Afghan law produced by the Foundation’s predecessor working group, the “Global Knowledge Transfer” working group at the Max Planck Institute for Comparative Public Law and International Law. These handbooks have assisted in the facilitation of further legal training in Afghanistan and have likewise made broader international discourse on Afghan law possible through their multi-lingual editions.

All materials the Foundation has produced have largely benefited from their diversity of contributors. The Foundation’s specialised research fellows predominantly provide insightful analyses that focus on comparative and international perspectives, while the legal experts of the Foundation’s Afghan partner organisations and those additional Afghan scholars within its network have augmented analysis through the added dimensions of domestic and Islamic law.
