Workshop for Legal Counsels of the Ministry of Justice and Constitutional Affairs

Max Planck Foundation Conducts Training on Legislative Drafting

On 7, 8 and 9 December 2021, the Foundation successfully delivered a workshop for legal counsels of the Ministry of Justice and Constitutional Affairs. The workshop, titled “Legislative Drafting: Principles, Methods and Processes,” marked the commencement of a series of workshops for the Ministry of Justice and Constitutional Affairs (“the Ministry”) within the framework of the German Foreign Office-funded project, “Support to the Constitutional Process in South Sudan”.

The Undersecretary of the Ministry of Justice and Constitutional Affairs, Hon. Dr. Gabriel Isaac Awow, who represented the Minister of Justice and Constitutional Affairs, officially opened the three-day workshop on 7 December.

The workshop comprised content based sessions addressing various topics such as the history, development and principles of legislative drafting, legislative drafting for thematic areas of law, the role of the drafting authority in legislative drafting and methods of legislative drafting. Other topics covered included: international standards and best practices for legislative drafting, the review and amendment of legislation and comparative perspectives on the legislative drafting procedure and processes. The workshop discussions were highly interactive with the participants keen to share their experience of legislative drafting in South Sudan and also seeking to understand comparative legislative drafting practices in other jurisdictions.

The workshop was officially closed by the Minister for Justice and Constitutional Affairs, Hon. Justice Ruben Madol Arol, H.E.  Tobias Eichner, Ambassador of Germany to South Sudan,  and the Managing Director and Head of Sub-Saharan Africa Operations at the Max Planck Foundation. Hon. Justice Ruben Madol Arol, in closing the workshop expressed the Ministry’s gratitude to the Max Planck Foundation and to the German Federal Foreign Office for their continued support in ensuring the delivery of topical workshops, not only to the Ministry, but also generally to the rule of law sector in South Sudan. In his remarks at the closing ceremony, H.E Tobias Eichner underscored the importance of the workshop in contributing to entrenching the rule of law through improved legislative drafting. He also reaffirmed the German Federal Foreign Office’s commitment to continued support for the Ministry of Justice and the various rule of law actors in South Sudan.
